Jessica advises local and international insurers on large, complex coverage matters and disputes, with a particular focus on directors & officers, cyber and information technology, management, and professional liability. She also defends insured directors & officers, engineers, IT service providers, and financial advisors against claims, including large-scale securities class actions. Her advice and approach to managing claims is technically precise while retaining a commercial and pragmatic perspective, with the interests of all stakeholders in mind.
Jessica has particular expertise in privacy law, which she applies to her practice in guiding insureds through large catastrophic cyber events, including events with significant multi-party and/or multi-jurisdictional impacts. She advises insureds on privacy regulatory issues that arise thereafter, including managing resulting third party liability risks and claims. She publishes articles and presents seminars to clients regularly on this rapidly developing area.
Jessica was the inaugural winner of the Australian Insurance Law Association Gill Award in 2020 for her paper on Decrypting crypto: The state of play and how insurers can catch up to the cryptocurrency boom.
- Advising Australian and London insurers on complex coverage issues concerning class actions, large multi-jurisdictional cyber incidents, large loss claims, claims by liquidators, investigations, and significant professional indemnity claims.
- Acting as incident responder for insureds experiencing significant cyber events and providing any necessary privacy regulatory or other legal advice. This includes providing strategic advice to minimise an insured’s third party liability risks in the aftermath of a cyber event, and responding to and defending any claims that do arise.
- Defending professionals across a variety of sectors, including engineers, IT service providers, stockbrokers, and accountants, in allegations that range from negligence and misleading and deceptive conduct to breach of contract and loss of opportunity.
- Defending insureds before investigations commenced by ASIC and the OAIC in relation to potential alleged breaches of statutory duties or privacy obligations.
